Terms of Service

These Terms govern your subscription to and use of the Qoomuz platform. By activating an account or using the platform, you agree to these Terms and any applicable order or service agreement.
1. Platform & License
Qoomuz provides a cloud-based business software platform for booking, customer relationship management, operations, reporting, and related workflows. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable right to access and use the platform during your active subscription for your internal business purposes.
2. Accounts & Authorized Users
You are responsible for the accuracy of account information, maintaining the confidentiality of login credentials, assigning appropriate access, and all activity under your account. You must notify us promptly if you suspect unauthorized access or a security incident involving your account.
3. Subscription, Billing & Taxes
Subscription fees, billing frequency, onboarding scope, and any additional services are confirmed in your order or service agreement. Recurring fees are due at the start of each billing period. Unless otherwise stated, fees are exclusive of applicable taxes. We may suspend access after reasonable notice if an undisputed payment is overdue.
4. Onboarding, Configuration & Integrations
We may configure fields, workflows, permissions, dashboards, and integrations as part of onboarding. You agree to provide timely access, information, decisions, and cooperation. Third-party products remain subject to their own terms, availability, and fees, and we are not responsible for changes made by those providers.
5. Acceptable Use
You may not misuse the platform, attempt unauthorized access, interfere with service operation, reverse engineer the platform except where law expressly permits, use it to violate applicable law or third-party rights, or upload malicious code. You are responsible for ensuring your use of customer and employee data is lawful.
6. Customer Data
You retain ownership of the business data you submit to the platform. You grant us the limited rights necessary to host, process, back up, and transmit that data to provide and improve the service. You are responsible for the accuracy, legality, and permissions associated with your data.
7. Platform Ownership
Qoomuz and its licensors retain all rights in the platform, software, designs, documentation, improvements, and underlying technology. A subscription provides access to the software; it does not transfer source code or ownership of the platform. Feedback may be used to improve the service without restriction.
8. Service, Updates & Support
We may update the platform over time, including adding, changing, or retiring features. We aim to maintain reliable service but do not guarantee uninterrupted availability. Support levels, response targets, and implementation assistance vary by plan or separate agreement.
9. Confidentiality
Each party agrees to protect non-public business, technical, and commercial information received from the other and to use it only for the subscription relationship. This obligation does not apply to information that is public through no breach, independently developed, or lawfully received from another source.
10. Cancellation & Termination
You may cancel according to your order or service agreement. Unless otherwise stated, cancellation takes effect at the end of the current paid billing period. Either party may terminate for a material breach that is not cured within a reasonable notice period. After termination, access ends and data may be deleted according to our retention practices.
11. Disclaimer & Limitation of Liability
To the maximum extent permitted by law, the platform is provided on an “as available” basis. Qoomuz is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or business interruption. Our aggregate liability arising from the service will not exceed the subscription fees paid for the affected service during the twelve months before the event giving rise to the claim.
12. Governing Law & Changes
These Terms are governed by the laws of the Kyrgyz Republic. Disputes will first be addressed through good-faith negotiation and, if unresolved, through the courts of Bishkek, Kyrgyzstan. We may update these Terms and will post the revised version with a new effective date.
